These Regulations implement the revised Waste Framework Directive (Directive 2008/98/EC), with Regulation 12 imposing a duty on organisations to apply the waste hierarchy in priority order of:
(a) prevention;
(b) preparing for re-use;
(c) recycling;
(d) other recovery (for example energy recovery);
(e) disposal.
